In the following terms and conditions:
The "Photographer” shall mean John Wright trading as "Red LightBulb Photography". The "Client” shall be whomever is responsible for booking the photography services. It is agreed that the following terms set out the total agreement made between the two parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.
Photography services, of any sort, offered by the Photographer are subject to a £25 or 25% non-refundable deposit (whichever is deemed the greater) and is payable at the time of booking . The remaining balance amount is due in full up to 48 hours prior to the day of the shoot. The Photographer will, at his discretion, accept cancellations and postponements for what the Photographer deems to be "valid" reasons and may, at his discretion, refund, either in full, or in part: Any and all cancellations with less than 48 hours notice will not receive a refund. Outdoor bookings may be dependent on the weather and the Photographer will take all reasonable steps to provide alternative days/dates/times in order to cover the contract.
The copyright of all photographs, files and documents relating to any service offered by the Photographer remains with the Photographer. The Photographer grants the Client permission to make copies of the images provided under the agreed contract and for the client to use those images for their own personal use. The Sale, re-sale, Publication, Entry to awards or competitions or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. The Photographer reserves the right to grant a license of use and charge a reasonable fee to license the use of any image provided to the Client. The Client agrees that the Photographer can use any or all photographs provided by any service offered for display and to promote the Photographer in any form of advertising, brochures, magazine articles, websites, social media, sample albums any any other media that the Photographer sees fit.
The Photographer will be responsible for creative choices in terms of the images captured during any shoot, but will take into account the Client’s reasonable instructions in respect of the Clients wishes/needs. Following completion of the shoot the Photographer will deliver images (which may be watermarked), sized for social media to the Client via an online gallery as soon as reasonably practical. No guarantee is given or offered with regard to completion times. All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer’s judgement regarding these corrections and the number of images put forward to the Client shall be deemed correct. Retouching, digital manipulation etc will be at the Photographers discretion and should the Client request more work to be completed, this may be available to the Client at an extra cost. The Client shall not be entitled to reject images on the basis of style or composition. The Clients "chosen" image/s will be delivered without watermarks or logos as a high resolution digital image. On delivery of the image/s the Client will be given the opportunity to purchase further high resolution digital images, prints or wall art and other items available for sale by the Photographer. These can be arranged at additional cost. Additional products will be arranged on receipt of full payment and delivered directly to the Client. The Photographer reserves the right to use third party product suppliers and cannot be held responsible for any third party companies mishandling of a product or the longevity of any product.
No travel expenses are charged for services up to 10 miles to or from any location (from or to the Photographer’s location at TS6). Additional mileage will be charged to the Client at 12p per mile. If a photography session is taking place on location, any entrance fees, parking fees or related expenses will be payable by the Client.
The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him in confidence for the purposes of services provided except where reasonably necessary to enable the Photographer to carry out his obligations in relation to the commission. Any information or data is kept in accordance with data protection principles set out in the Data Protection Act available on the ICO (Information Commissioner’s) website. The Photographer does not hold Clients information, save that provided on the booking form.
The Photographer will take all reasonable steps to ensure equipment is in good working order, backup equipment is available where appropriate and that images are backed up in a responsible manner. In the unlikely event of a total photographic failure, loss of images or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. The Photographer will not be held responsible for any damage or loss to the Client, Clients family, pets, vehicles or objects in respect of any location shoot or photography session. The Client agrees that their pet is the Clients sole responsibility at all times and that the Client is totally and individually liable for any damage or harm caused by their pet at all times.
Statement of acceptance
By booking Red LightBulb Photography the Client accepts that they have read, understood and agreed to abide by these terms and conditions and that these terms and conditions are subject to modification without notice.
